Only the German original of these General Terms and Conditions of OOMF LLC is legally binding. The English translation is provided for information purposes only.
Scope of application
The present general terms and conditions (hereinafter "GTC") apply to all orders made through the online shop "oomf.store" operated by OOMF LLC, OOMF GmbH, Kreuzstrasse 57B, 8712 Stäfa, CHE-279.377.109, hereinafter referred to as OOMF LLC.
With the confirmed order, these GTC are accepted by the customer.
Product and Price
Illustrations of products in advertising and in the online shop are for illustration purposes only and are non-binding. In the case of wood products it is pointed out that the grain of the wood used is different on each product and the displayed product pictures represent only sample photos.
Unless expressly stated otherwise in the ordering process, the prices displayed on the product page include the value-added tax and other price components (e.g. packaging and shipping) and are in Swiss Francs (CHF). Further taxes and costs are not applicable (with exception of customs duties and shipping costs for deliveries abroad).
OOMF LLC reserves the right to change prices at any time. The prices stated in the online shop at the time of order placement apply.
Products and prices stated in the online shop are deemed to constitute offers. However, these offers are always subject to deliver inability or incorrect price quotations, both of which lead to contract cancellation.
A contract shall be deemed concluded as soon as an order has been placed by the customer in the online shop.
The arrival of an online order is indicated to the customer by an automatically generated order confirmation to the e-mail address provided by the customer. Receiving this automatically generated e-mail does not imply that the product can actually be delivered. It solely indicates that the order placed has arrived at the online shop and thus a contract with OOMF LLC was concluded under condition of deliverability and correct price quotation.
Conditions of delivery
The goods are delivered within Switzerland and Europe.
Unless otherwise stated in the ordering process, the delivery time is 1 to 3 business days for delivery within Switzerland and Liechtenstein. Delivery also takes place on Saturday, where applicable. For deliveries to the EU the delivery time is between 5 to 10 working days.
The customer has to check the delivered goods immediately for correctness, completeness and delivery damage.
Damages, incorrect and incomplete deliveries must be reported within 5 calendar days from the date of delivery.
OOMF LLC warrants for two years from delivery date that the ordered product will be free from defects and fully functional.
The liability is governed by the applicable legal provisions. However, liability is excluded for slight negligence on the part of OOMF LLC as well as damages which are attributable to improper storage or use of the products by the customer.
The payment options offered to the customer under "Payment options" are available for payment.
The current fees are shown under "Payment options" and are laid out in detail in the course of the order process.
Order change or cancellation
If the order has not yet left the logistics center, the order can be canceled or changed. The resulting costs of CHF 5 are borne by the customer.
In the event of inability to deliver (condition leading to termination) after order placement or contract conclusion, the customer is immediately informed by e-mail. If the customer has already made a payment, the amount is refunded. If no payment has been made, the customer is exempted from the obligation to pay the amount due.
Return of non-defective products
The return of defect-free goods is possible at the discretion of OOMF LLC after inspection of the goods. The shipping costs will be borne by the customer.
Should individual terms of these GTC be invalid or void, the validity of the other provisions of these GTC shall not be affected.
Place of jurisdiction and applicable law
All legal relations between OOMF LLC and its customers are subject to substantive Swiss law, the United Nations Convetion on Contracts for the International Sale of Goods (CISG) does not apply.
The place of jurisdiction is determined by by the applicable legal provisions.
